Risk and risk treatment
Neither party will be liable to the other for any delay or interruption in performance as to any obligation in this Terms and Conditions resulting from but not limited to governmental emergency orders, judicial or governmental action, emergency regulations, sabotage, riots, terrorist action, labor strikes or disputes, natural diasters, fires, electrical failure, major computer hardware or software failures, equipment delivery delays, acts of third parties, or delays or interruptions in performance beyond its reasonable control. If a serious problem caused the Customer’ computer system to be destroyed completely or partly and which is not the fault of neither the Bank nor the Customer, we will give the Customer our support to recover the data.
Fees and charges
You authorize us to automatically debit any of your account(s) with us to collect any kind of fees and charges for Internet Banking Transactions as quoted in our banking tariff. The Bank reserves the right to review and change such fees and charges from time to time.
Email
Email messages sent to the Bank over the Internet cannot be guaranteed to be completely secure. The Bank is not responsible for any damages incurred by users if they send a message to the Bank, or if the Bank sends a message to them at their request, over the Internet. The Bank is not responsible in any way for direct, indirect, special or consequential damages arising out of the use of this website.
Assignment
The Bank may at any time assign or delegate its rights and obligations under these Terms and Conditions to any of its affiliates which are owned or controlled by the Bank, its parent company or any successor in interest. Bank may also assign or delegate certain of our rights or obligations under these Terms and Conditions to independent contractors or other third parties. You may not assign your rights and obligations under these Terms and Conditions to any other person or entity.
Amendments
The Bank may amend these Terms and Conditions from time to time by publicizing notifications on its website.
Commitment on implementation and dispute settlement
Both parties are committed to strictly implementing the Terms and Conditions. Any dispute arising during the implementation shall be settled by negotiation or reconciliation.The dispute that can not be resolved by negotiation or reconciliation shall be brought before the competent courts
Applicable laws
These Terms and Conditions are governed by and shall be construed in accordance with the Law in force in Vietnam.The Terms and Conditions are made into Vietnamese and English. In case of any discrepancies between the English and Vietnamese versions, the Vietnamese version shall prevail.
